Tell him your contacting vosa to come & inspect it & you think its a hooky mot
vosa will rip the garage apart & go through all the previous mots & paper work
they wont want the hassle, plus you will be contacting
the financial Ombudsman to fight your case they will get your money back
he will brick it even more, but the legal side is that the dealer has to be
given the chance to do the repairs (he prob wont know this) ;)
 
Now sure how to play this now... Do I just keep asking for my money back (even though he reckons he hasnt got it) and hope that he caves eventually.
or do I tell him im gonna go and have the car MOTed elsewhere, get a list of things that need fixing... either way im guessing im not gonna get my money back nor do I want his 'mechanic' repairing the motor.

@Land_girl ......I see you're in Essex........if you're not far from Grays/Basildon I could MOT it tomorrow afternoon or Saturday morning........at least then you'de get a proper test and know exactly what it needs ..or doesn;t..........Failing that check with your local council , a lot operate a MOT station for their own use and members of the public are welcomed
Thank you for your offer. I am going to throw a little more at him first (dont really want to pay out for inspections and MOT's if i can help it). I will be incontact if all else fails tho thank you.

I very much suspect he WILL know he has to be given the chance to repair.

My feeling is an independent inspection then use that as leverage with a threat to go to VOSA (now called Driver & Vehicle Safety Agency, DVSA) which would throw a spanner in his relationship with his 'friendly' MOT inspector. Something he won't want to lose.

does he 'have' to be given the chance to repair it? whats the point in taking it back to a cr@p garage to have it fixed?

By law yes they must be given the chance to correct the faults but its rotten with a hole in it & the blame is
on the mot tester not the seller (prob his mate taking a back hander though)
As for rusted areas its finger thumb pressure if he pushes it & he doesn't put a hole in it ...…its a pass !!
It will what used to be an advisory but they changed it last month to minor faults + advisorys
I would have though he would have put minor fault to cover his ass at the very least.

Right, in that case then, ill just threaten him with the lot... my message will read something along the lines of... "I have taken advice to have the car independently inspected and take the findings to DVSA (previously VOSA) followed shortly after, a letter to the financial ombudsman."
What do you guys think?

That sounds good to me, he'll be in no doubt that you know what you're talking about and can't be easily fobbed off.

He knows that he can legally offer to fix it before you can take the legal route for a refund but it doesn't let the 'mates' MOT off the hook.

I'd give breakdown of trust as a reason for not wanting him to have it fixed by him in any follow up conversation.

He'll have to cough up or risk dobbing his mate in it.

With regard to him 'knowing he can legally offer to fix it'... He really aint the brightest spark in the box so im not sure that is the case, but if he does suggest repairing it, i'll do as you say 'breakdown of trust'. ;)
 
well hes come back with a load of bullocks... saying I have to tell him where i had the car looked at today, because i've asked for a refund it is now 'recovered' and none of the 4 wheels can touch the floor and i need to give him evidence that this is the case, i need to show him the mileage and where it is parked, all independent inspections have to be mutually agreed with him or they are bias. blah blah blah...

can you get any pics of the chassis at the rear or anywhere its rotten plus the hole at the front
