NO surprise there then. Though I believe some one was postulating on this very forum, That dodgy MOT's don't exsist anymore:confused: You can obviously prove he doesn't know squat!!.

As has been said TS will advise you on ways to recover all your costs. I'd speak to a brief and see what else you can do.

agreed. whilst VOSA can prevent counterfeit MOT's. They can't as yet prevent complete pricks picking up a spanner and issuing a docket...

it may well have been me doing the postulation mentioned - and i still stand by what i said as the MOT is electronically recorded and VOSA do audit tests and are VERY interested in vehicles such as yours that appear to have been issued with a cert yet are clearly issue ridden

i remember a few peeps saying that "the garage round the corner" from them would give a rusty tescos trolley a cert for the right price - that may well be the case but as the tests are primarily electronically recorded they wont escape the VOSA inspectors as used to be the case not so many moons ago

the issue of a dodgy mot cert is no different than it used to be.. the only difference now is that vosa have an easier way of tracking mot certs issued, but the penalties for dodgy certs are worse now than they used to be.

The MoT on my motor was definitely written in crayon, every bush split, boot floor rotten, 1 tyre illegal, 3 of 4 track rod end had split boots, battery not secured, emmissions - you could smell the unburnt petrol a mile away when it was moving, exhaust blowing, etc, etc. That was when I bought it 6 months and 400 miles after the ticket was issued, one of mates is a MoT tester he was dumbstruck it had a ticket. All nasty bits now fixed:)

A further update is the disco has been seized. I have gone to TS and they have been brilliant, they have given me a bit of direction. I can legally hire a car now (like for like) and bill it back to the garage/dealer.

all I want is my money back but I have to right a formal letter and send it recorded delivery first.

Well done. Keep copies of everything and make sure you don't lose out. Remember to thank the TS when it's all settled - a bit of customer appreciation goes a long way in local gov!

A further update... sorry to bore you all
VOSA are testing the car on Wednesday, apparently they invite the original testers to the VOSA test even better is the fact that I can also attend although going by what the VOSA guy has said he would rather I didn't come along.
"I want to smash his ****ing face in" probably didn't help.
If it had just been down to money I would not have been so angry, the fact that my wife is pregnant he knew it and knew she was at risk has just made me so very, very angry.

The final post....
I have the disco back and it did fail on the brakes - I understand the garage will now get dragged over the coals. On a positive note the VOSA inspector said that it is by far the best condition disco 1 he has ever seen. He said that it has probably been waxoyled whenever required and he has never seen one so well protected (he seemed a little jealous :) )
all the failures have now been sorted free of charge by the original garage, so I am well happy now.
Old bill will sort out the dealer. (he is still being a dick)

Thank you all for your help.

Right I need to go and get it dirty now.... might take the disco out too!

Congratulations. Get out there and enjoy!

I've just seen that some of you are going to Salisbury plain. I haven't been there since my Army days. I would love to take it down there but I haven't done an off roading before (except as a passenger in a field ambulance that was prone to tip over)
