Freelander 1 td4 tailgate problems

Hi guys hope all are well new to this forum but here goes bit of a weird one. I have an 06 Freelander td4 sometimes when I get into the car and turn key in the ignition the rear tailgate opens up by itself. However if I press the window/door lock button before starting it doesn't open. Does any one have any ideas of what this could be.

If I permanently locked it would it be an MOT failurr?
